I think that person caught a case of CDD .... once he surged into the "lead," that is.....

That would depend on what place you were in before you passed the person in 2nd.  If you were in 3rd place and then passed the person in 2nd, you would then be in 1st place. If you were in last place and the person in 2nd lapped you, and then you passed them, you would still be in last place.
