why is $${\left(-{\mathtt{1}}\right)}^{\left({\frac{{\mathtt{3}}}{{\mathtt{8}}}}\right)}$$ not valid/real?

(-1)^(1/8) is not a real number, it is imagniary. You are effectively trying to sqaure root a negative number (multiple times due to the 8) which leads to imaginary numbers. Despite the 3/8, it is still not possible.
